Acceptance of the terms of sale

1. The contract between Fabris Coffee and the Customer shall be concluded with the acceptance, even partial, by Fabris Coffee. This acceptance is automatic, unless otherwise communicated to the client. By placing an order in the manner provided, you acknowledge that you have read all the information provided during the purchase process, and accept the general conditions transcribed below.

2. Once the online purchase procedure is finished, the customer will print or save an electronic copy of the order, and keep these general conditions subjected to the requirements of Art. 3 and 4 of Decree No. 185/1999 on distance selling in mind.

3. It is excluded any right of the Customer to compensation, and any contract or tort liability for any direct or indirect personal and / or property damages, caused by the rejection, even partial, of an order.

How to Buy

4. The customer can purchase only products on the electronic catalog of Fabris Coffee viewable online at www.fabriscaffe.com at the time of the order, as described in the relevant information sheets. It is understood that the picture accompanying the description of a product may not be fully representative of its features but differ in color, size, and accessories in the picture. All support information for purchase are intended as mere material for general information, not due to real characteristics of a single product.

5. The order is confirmed by Fabris Coffee by e- mail sent to the email address supplied by the customer during the order. This confirmation message will contain date and time of order execution and a 'Customer Order Number', to be used in any further communication with Fabris Coffee. The message will include all datas entered by the customer who agrees to verify the correctness and communicate any corrections, as described in this document.

6. In the case of non-acceptance, Fabris Coffee ensure timely notification to the customer.

Payment methods

7. Credit card. In the event of purchasing goods with credit card payment: the conclusion of the online transaction will authorize the bank to transfer only the amount of your purchase.

7.1 In the event of cancellation by both the Customer and in case of rejection of the same by Fabris Coffee, prompted cancellation of the transaction and release the amount involved by the same Fabris Coffee will be processed. The timing of release for certain types of cards, depend exclusively on the banking system and can be up to their natural expiry date (24 days from the date of authorization). Once the cancellation of the transaction, in no event Fabris Coffee can be held liable for any damages, direct or indirect, caused by delay in the failure to release the amount committed by the banking system.

7.2 Fabris Coffee reserves the right to charge the customer's credit card in order to avoid the expiration of the authorization of the transaction that takes place on the 23rd day.

7.3 Fabris Coffee reserves the right to ask the customer for private information (eg. Landline phone number) or to receive copies of documents proving used card ownership. In the absence of the required documentation, Fabris Coffee reserves the right to refuse the order.

7.4 At no time during the purchase process Fabris Coffee is able to know information about the buyer's credit card, sent via secure connection directly to the bank handling the transaction. No archive of Fabris Coffee retain such information. In no event Fabris Coffee can be held responsible for any fraudulent use of credit cards by third parties, upon payment for products purchased on www.fabriscaffe.com.

7.5 The credit cards accepted are all those who lean to the circuits indicated on our site Carta SI, Mastercard and Visa.

8. Mark

8.1 The balance of the carrier may be through:

Label with cash: Make a Payment to the courier upon delivery of the product purchased. Following the DL n. 201 of 6/12/2011 cash can not be used for amounts equal to or greater than 1'000,00 euro. The courier will only accept exact sums; is not expected to return the rest.
Label with check or money order: Make a Payment to the courier upon delivery of the product purchased. The courier will only accept checks or bank drafts payable to Fabris Coffee, dated, signed, non-transferable and not transfered. 

9. Wire Transfer Policy: If paying by bank transfer in advance, Fabris Coffee is committed to keeping locked the price of the product of your interest for a few days the time normally necessary to complete the transfer of the currency practices.

The sending of the order will only take place when the actual crediting of the amount due on the c/c of Fabris Coffee which must be done within 7 working days from the date of acceptance. Going beyond these limits, the order will be automatically canceled. The purpose of the bank transfer must contain:

  · The order reference number;

  · The date of the order;

  · Name and surname of the purchaser.

10. Purchases via PayPal: In the event of purchasing goods with PayPal payment method, together with the completion of the online transaction, PayPal will immediately charge the amount of your purchase.

10.1 In the event of cancellation by both the Customer and in case of rejection of the same by Fabris Coffee, the amount will be credited back to the customer's PayPal account. The timing of re-credit of the payment within the PayPal chosen account depends exclusively on PayPal and the banking system. Once the chargeback amount PayPal account, in no case Fabris Coffee can be held liable for any damages, direct or indirect, caused by delays in crediting employees from PayPal or from the banking system.

10.2 Fabris Coffee reserves the right to ask for customer information (eg. Landline phone number) determining the actual ownership of the PayPal account. In the absence of the required documentation, Fabris Coffee reserves the right to refuse the order.

10.3 In no time of the purchase Fabris Coffee is able to know information about the buyer's credit card or financial information of the PayPal account. In no event Fabris Coffee can be held responsible for any fraudulent use of credit cards by third parties, upon payment for products purchased on www.fabriscaffe.com.

Delivery options and charges

11. www.fabriscaffe.com can only accept orders for delivery in Italian territory, orders for delivery in other countries may be managed by arrangement. In this case the shipping costs will be calculated and communicated to the customer after the order and method of payment provided will be the bank transfer. The cancellation is possible until the completion of the order occurring with of the transport document or invoice issuance.

12. For each order placed, Fabris Coffee issues an invoice of the goods shipped, and sends it via e-mail to the Customer, in accordance with Article 14 of Presidential Decree 445/2000. For the invoice issuing, the information provided by the Customer at order time will be used. No change in the bill will be possible after the issuance thereof.

13. The cost of delivery and / or incidental charges are paid by the customer. The payment method used will be the one chosen by the Customer during the order process. Nothing is more due by the customer then the amount of the order shown at the end of the purchase process.

13.1 Shipping costs are fixed. 10 EUR excluding VAT regardless of destination Italian reference.

14. No responsibility can be attributed to Fabris Coffee in case of delay in the order completion or delivery.

15. The delivery of the order refers to land shipment unless communication by our customer service.

Any damage to the packaging and / or product or mismatch in the number of packages or particulars, must be immediately notified, writing result of the inspection (specifying why misgiving, eg. "Packaging broken", "packaging crushed" etc.) on the proof of delivery courier. Once signed the slip, the customer can not make any objection about the goods appearance.

Any problems concerning the physical, correspondence or completeness of the products delivered must be reported within 5 days from delivery by fax or registered mail.

16. In case of collection failure of the material from the courier warehouses within 5 working days from the first delivery attempt because of repeated inability to deliver to the specified by the Customer address, the order will be sent back to the Fabris Coffee warehouses.

17. Once the slip is signed, the customer can not make any objection about the appearance of the goods. Fabris Coffee reserves itself to require in any case further documentation to the customer to prove the actual damage.

Returning products

18. Any product returns must be agreed and authorized with a return number (RMA).

19. The RMA number must be clearly printed on the delivery note.

20. The materials returned because of incompatibility (not subject to our product), or for warranty repairs resulting then functional, will be subject to a charge of € 26.00 flat rate for operating expenses.

21. The products must be returned in their original packaging and with adequate external packaging.

22. No claims are accepted after 10 days from delivery.

Guarantees

23. All products sold by Fabris Coffee are covered by the manufacturer's standard warranty and 24-month warranty for defects, according to Legislative Decree 24/02. The manufacturer's standard warranty is provided in the manner described in the documentation included in the packaging of the product and on the site www.fabriscaffe.com. To use the warranty, the customer will keep the invoice (or DDT) that will receive via e-mail in PDF format. The use of the warranty may be required in case of request for assistance to authorized service centers in the area and / or to follow procedures outlined in the documentation provided with the product packaging.

24. The manufacturer's standard warranty is provided in the manner described in the documentation included in the packaging of the product. If, as a result of intervention by an Authorized Service Center, the defect is not covered by the manufacturer's standard warranty, the customer will be charged for any costs of verification and recovery required from the authorized assistance, as well as transportation costs if provided by Fabris Coffee.

25. The guarantee of 24 months under the Legislative Decree 24/02 applies to products that present a lack of conformity, provided that the product is used correctly, respecting its intended use and as provided in the technical documentation. In case of lack of conformity, Fabris Coffee provides, without cost to the customer, the restoration of conformity by repair / replacement or reduction of price, until the termination of the contract. If, as a result of intervention by an Authorized Service Center, the defect does not result in a lack of compliance pursuant to Legislative Decree 206/05, the customer will be charged for any costs of verification and recovery required from authorized assistance, as well as transportation costs if provided by Fabris Coffee.

26. The replacements in case of DOA (Dead On Arrival: product not working on delivery) takes place only if expressly provided by the manufacturer. The timing of replacement or repair of any product depends solely on the policies of the manufacturer.

27. If, for any reason, Fabris Coffee is unable to provide its customers with a product of quality, Fabris Coffee will proceed at its own discretion to refund the amount paid taking into account the use of the property or its replacement with a product of equal or superior characteristics.

28. The repairing or replacing time of the product depends on the policies of the manufacturer only and no damage can be obtained from Fabris Coffee for any delays in repairs or replacements.

29. In cases where the warranty application foreseen for the return of the product, the product must be returned by Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc...); to limit damage to the original package, we recommend to enter into a second box; should be avoided in all cases the attachment of labels or tape directly on the original product packaging.

The customer will be given an authorization number to return the product (RMA) to be shown outside of the package, following the instructions provided directly in the relevant e-mail for authorization.
